Ducey Terms of Service

Effective Date: 1 July 2026

These Terms of Service ("Terms") govern your access to and use of Ducey, including the website, platform, applications and related services (collectively, the "Services").

Ducey is operated by Katrina Camrass trading as Ducey ("Ducey", "we", "our" or "us").

By creating an account, accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use the Services.

If you are using Ducey on behalf of a company, agency, production company or other organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Services

Ducey provides a production workspace that assists users in organising and managing multimedia productions, projects, shoots and related production activities.

Features may include:

  • Project workspaces
  • Production documentation
  • Call sheets
  • Budgets and budget tracking
  • Scheduling tools
  • Team collaboration
  • Shared project pages
  • File storage
  • Project communication tools

We may modify, add or remove features from time to time.

3. Accounts

Users must provide accurate and current information when creating an account.

You are responsible for:

  • Maintaining the security of your account
  • Protecting passwords and login credentials
  • All activities conducted under your account
  • Promptly notifying us of unauthorised access

Ducey is not responsible for losses resulting from unauthorised use of your account where reasonable security measures have not been maintained.

4. Workspaces and Team Members

Each workspace has a workspace owner. The workspace owner is the account holder responsible for the workspace, including payment of any applicable subscription fees.

Workspace owners may invite employees, contractors, freelancers, clients and other authorised participants into a workspace.

The workspace owner is responsible for:

  • Managing permissions
  • Inviting authorised users only
  • Removing users when access is no longer required
  • Ensuring payment information is current
  • Ensuring compliance with these Terms

Users invited into a workspace must also comply with these Terms.

5. User Content

Users may upload, create and store content including:

  • Project information
  • Production documents
  • Call sheets
  • Budgets
  • Contracts
  • Crew information
  • Client information
  • Files and attachments

You are solely responsible for all content uploaded to Ducey.

You warrant that:

  • You own the content or have authority to use it.
  • Uploading the content does not infringe any third-party rights.
  • You have obtained any required permissions or consents relating to personal information contained within the content.

6. Ownership of Content

Users retain ownership of all content uploaded to Ducey.

Ducey does not acquire ownership rights in user content.

You grant Ducey a non-exclusive, worldwide licence to host, store, process, reproduce and display content solely for the purpose of providing the Services.

7. Shared Links and External Access

Ducey may permit users to share project information through external links.

Users are responsible for:

  • Determining whether information is appropriate for sharing
  • Managing access to shared links
  • Monitoring the distribution of shared content

Shared links expire after 30 days and/or when the relevant production is archived.

Ducey is not responsible for information disclosed through links intentionally shared by users.

8. Acceptable Use

You must not:

  • Use Ducey for unlawful purposes
  • Upload malicious software
  • Attempt to gain unauthorised access to systems or accounts
  • Interfere with platform security
  • Upload content that infringes intellectual property rights
  • Use Ducey to distribute spam or harmful content
  • Reverse engineer or copy the platform

We may suspend or terminate accounts that violate these Terms.

9. Subscription Plans and Billing

Ducey may offer:

  • Trial Plan
  • Standard Plan
  • Pro Plan

Subscription fees are published on our website and are billed in Australian dollars (AUD).

Subscription fees may be updated from time to time. Users will be notified before changes occur.

Payments are processed through Stripe or other authorised payment providers.

Subscriptions automatically renew at the end of each billing period unless cancelled.

Users authorise Ducey and its payment providers to charge applicable subscription fees.

10. Cancellation and Refunds

Users may cancel their subscription at any time through their account settings.

Cancellation takes effect at the end of the current billing period.

No refunds or partial refunds are provided for:

  • Subscription fees already paid
  • Unused subscription periods
  • Downgrades during a billing cycle

Access to paid features may continue until the end of the current subscription period.

Data may be retained for up to 30 days following cancellation or expiry of the subscription. After 30 days, account data, project data and uploaded content will be deleted.

11. Privacy

Your use of Ducey is also governed by our Privacy Policy, available at:

By using Ducey, you acknowledge that you have read and understood the Privacy Policy.

12. Availability of Services

While we aim to provide reliable access to Ducey, we do not guarantee uninterrupted or error-free operation.

Services may be unavailable due to:

  • Maintenance
  • System upgrades
  • Security incidents
  • Third-party service interruptions
  • Events beyond our reasonable control

13. Data Backups and Business Continuity

Users are responsible for maintaining copies of important production information and documentation.

Ducey implements reasonable measures to protect and preserve user data.

However, Ducey does not guarantee against loss, corruption or unavailability of data.

Users should maintain independent backups of critical information.

14. Artificial Intelligence Features

Ducey may introduce AI-assisted features in future releases.

Where such features are introduced:

  • AI outputs may contain inaccuracies.
  • Users remain responsible for reviewing outputs before relying on them.
  • Additional terms may apply to AI functionality.

Ducey will not use project data to train AI models unless expressly disclosed and agreed.

15. Intellectual Property

All intellectual property rights in Ducey, including software, branding, design, content and platform functionality, remain the property of Ducey or its licensors.

Nothing in these Terms transfers ownership of Ducey's intellectual property to users.

16. Limitation of Liability

To the maximum extent permitted by law:

  • Ducey is provided on an "as is" and "as available" basis.
  • Ducey does not warrant that the Services will be uninterrupted, secure or error-free.
  • Ducey is not responsible for project delays, missed deadlines, lost opportunities, production errors or financial losses arising from use of the Services.

To the extent permitted by law, Ducey's total liability arising from any claim relating to the Services will not exceed the subscription fees paid by the user during the 12 months immediately preceding the event giving rise to the claim.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under Australian Consumer Law.

Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

18. Indemnity

You agree to indemnify and hold harmless Ducey, its operator and representatives from any claims, losses, liabilities, damages and expenses arising from:

  • Your use of the Services
  • Your content
  • Your breach of these Terms
  • Claims relating to information uploaded by you

19. Termination

We may suspend or terminate access to Ducey where:

  • These Terms are breached
  • Use of the Services creates legal or security risks
  • We are required to do so by law

Termination does not affect accrued rights or obligations.

20. Changes to Terms

We may update these Terms from time to time.

Where changes are material, users will be notified by email or through the platform.

Continued use of Ducey following updated Terms constitutes acceptance of those changes.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the exclusive jurisdiction of the courts of New South Wales.
